General Terms and Conditions

of Rhöner Drachen- und Gleitschirmflugschulen Wasserkuppe GmbH (hereinafter: RDGW GmbH), legally represented by the Managing Director

The following terms and conditions are written in German and can be saved to the user's device or printed. Upon request, they can be obtained from RDGW GmbH, Wasserkuppe 46, 36129 Gersfeld, or via email at info@gleitschirm-direkt.de in digital or written form. They will also be provided to the customer with every delivery of goods.

The official address of RDGW GmbH and the authorized representatives can also be found on the invoice.

1. Scope

These General Terms and Conditions apply to all business transactions conducted by RDGW GmbH, regardless of their nature, provided the contractual partner has been informed of these terms and conditions. They also apply without explicit reference to any future business relationships, provided they have become the basis of a contract once.

2. Formation of Contract

Contracts on this platform can only be concluded in German.

You submit a binding offer to RDGW GmbH when you complete the online order process by entering the required information and clicking the "Place Order" button in Step 4. After submitting your order, we will send you an email confirming receipt of your order and outlining its details (Order Confirmation). This Order Confirmation does not constitute acceptance of your offer but is intended to inform you that your order has been received.

The contract is only concluded when the ordered goods are dispatched to you.

The offers on the RDGW GmbH website are non-binding. This means RDGW GmbH is not obligated to perform in cases of non-availability. However, a contract and contractual obligation for individual services arise if RDGW GmbH confirms the customer's order in text form.

RDGW GmbH reserves the right to deliver goods of equivalent quality and price if the ordered goods are unavailable and the customer has agreed to this procedure in the order form. If the customer disagrees with these goods, they may choose rectification, compensation, reimbursement of futile expenses, reduction, or withdrawal from the contract.

3. Identity of the Contractual Partner

The contract is concluded with RDGW GmbH unless explicitly stated otherwise.

4. Storage of Contract Text

Your order details are stored in our system. If you wish to receive them in printed form, you can print the "Order Confirmation," which appears on your screen after submitting the order. If you have provided your email address, you will also receive all relevant order details via email, which can also be printed.

5. Product Selection

Customers can select and order products on the website.

For each product, customers receive a detailed product description on the respective webpage. This description is also provided in printed form upon delivery of the ordered goods.

Selected products are added to a virtual shopping cart, and the customer receives a summary of the selected products and the total price, including VAT, at the end of the shopping process.

Before submitting the order, RDGW GmbH allows customers to check and correct the order details, particularly regarding prices and quantities.

6. Right of Return

Right of Return
You can return received goods without stating reasons within 14 days by sending the goods back. The period starts upon receipt of this information in text form (e.g., letter, fax, email) but not before the goods have been received by the recipient (in the case of recurring deliveries of similar goods, not before receipt of the first partial delivery) and also not before fulfilling our obligations under Article 246 § 2 in conjunction with § 1 (1) and (2) EGBGB and § 312g (1) sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. For goods not suitable for parcel shipment (e.g., bulky items), you can request a return in text form. Sending the goods or the return request in time is sufficient to meet the deadline. Returns are at our expense and risk.

Consequences of Return
In the event of a valid return, the services received by both parties are to be returned, and any benefits derived (e.g., use advantages) must be handed over. If the item has deteriorated or benefits cannot be returned or only partially returned or only in a deteriorated condition, you must compensate us for the value. Obligations to refund payments must be fulfilled within 30 days. For you, this period begins with sending the goods or the return request; for us, it begins with receipt.

7. Prices

All prices are stated in euros, include statutory VAT, and are ex works RDGW GmbH, plus applicable packaging and shipping costs.

8. Execution of the Contract

Order Processing
We will process orders within 72 hours and inform customers whether the requested products are available.

Delivery
If the ordered products are available, we will ship them within three days of receipt of payment. Non-stock items will be delivered as soon as possible.

Shipping Costs
At RDGW GmbH, a flat shipping fee of €6.90 usually applies. This covers part of the costs for postage/shipping and packaging, with RDGW GmbH covering the rest. In exceptional cases, we may charge a higher flat rate, which will be specified accordingly. If technical or logistical reasons require multiple shipments, shipping costs will only be charged once. For international shipments, shipping costs will be calculated based on the actual expenses incurred.

Changes, Extensions, Limitations of the Order
RDGW GmbH will respond promptly to customer inquiries regarding changes, extensions, or limitations of the product scope for existing orders. If the customer requests changes, extensions, or limitations up to five working days before the planned delivery, RDGW GmbH will accommodate these requests to the extent possible.

9. Service Hotline

RDGW GmbH provides a hotline for customer inquiries related to products. This hotline is available five days a week (Monday to Friday, excluding public holidays) during regular business hours (9:00 AM to 5:00 PM). RDGW GmbH will additionally notify customers of this hotline on the invoice.

10. Warranty and Liability

If delivered items have obvious material or manufacturing defects, including transport damage, please report such defects immediately. Failure to report does not affect your statutory rights.

For defective products, customers should send the product to RDGW GmbH at its expense.

The warranty of RDGW GmbH follows statutory provisions, particularly §§ 433 ff BGB. In business transactions, the warranty is limited to one year, and RDGW GmbH reserves the right to repair or replace the product free of charge at its discretion.

RDGW GmbH is liable:

  • For gross negligence by its management and senior staff.
  • For any culpable breach of essential contractual obligations.
  • For gross negligence of simple agents unless RDGW GmbH can disclaim liability due to commercial practices.
  • In the last two cases, liability is limited to typical, foreseeable damages.

Contributory negligence by the customer will be taken into account.

Liability for intent, guarantees, fraud, personal injury, and under the Product Liability Act remains unaffected.

11. Retention of Title

Until full payment is received, the goods remain the property of RDGW GmbH.

12. Payment, Due Date, Default

RDGW GmbH issues an invoice to the customer for the ordered goods, which is handed over upon delivery. RDGW GmbH delivers against advance payment via bank transfer or PayPal. Advance payments or credit card charges will be deducted from the invoice amount.

For delivery against invoice, customers agree to pay the invoice amount within 14 days of receiving the goods. Use the transfer form attached to the invoice, or transfer the amount with the order number to the following account:

Invoice prices are always end-user prices, including VAT.

In case of default, consumers must pay default interest of 5 percentage points above the base rate unless RDGW GmbH can demonstrate higher interest. For business customers, the default interest rate is 8 percentage points above the base rate.

13. Force Majeure

If RDGW GmbH is unable to fulfill its obligations due to force majeure (e.g., war, natural disasters), it is released from its performance obligations for the duration of the impediment. If RDGW GmbH is unable to execute the order or deliver the goods for more than one month due to force majeure, the customer is entitled to withdraw from the contract.
